A proposed condominium development in Bridgeport’s Black Rock neighborhood has suffered a legal setback with a judge’s ruling against a zone change approved by the Planning and Zoning Commission.

Brennan Builders’ proposed development at 11-27 Bywater Lane called for up to seven townhouse-style units, requiring a zone change because the neighborhood is zoned for single and two-family structures.

The Planning and Zoning Commission approved the project in November.

In a 36-page decision, Judge Dale Radcliffe ruled that the zone change does not conform to the city’s comprehensive plan and serves the needs of a single land owner, the Connecticut Post reports.

The decision also states that owners of a property across from the development was not properly notified of the zoning hearing.

The ruling said Planning and Zoning Commission Chairman Melville Riley showed bias towards the developers and their attorney Raymond Rizio, and “belittled and demeaned” residents who spoke out against the plan.

Joel Green, an attorney for neighbors opposed to the development, told the Post that they were pleased with the decision.
